1. Acceptance of Terms

By accessing or using the Synctower website, mobile application, or related services ("Services"), you agree to be bound by these Terms and Conditions. If you do not agree, you must not use the Services.

2. About Synctower

Synctower is a software platform that assists condominium corporations, property managers, boards of directors, residents, and authorized users with communication, document management, amenity bookings, maintenance requests, visitor management, and other community management services.

3. User Accounts

You are responsible for:

• Providing accurate account information.
• Maintaining the confidentiality of your login credentials.
• All activities that occur under your account.
• Promptly notifying Synctower of any unauthorized access.

4. Acceptable Use

You agree not to:

• Use the Services for unlawful purposes.
• Upload malicious software or harmful content.
• Attempt to gain unauthorized access to other accounts or systems.
• Interfere with the operation or security of the Services.
• Harass, threaten, or abuse other users.
• Upload content that infringes the rights of others.

5. Customer Data

The condominium corporation or property management company remains responsible for the accuracy and legality of information uploaded to Synctower.

Users retain ownership of their content. By using the Services, you grant Synctower permission to process and store information solely to provide the Services.

6. Subscription and Fees

Certain features may require a paid subscription.

Subscription fees, billing cycles, and renewal terms will be specified in the applicable service agreement or order.

Failure to pay applicable fees may result in suspension or termination of Services.

7. Availability

We strive to provide reliable service but do not guarantee uninterrupted or error-free operation. Maintenance, updates, or circumstances beyond our control may temporarily affect availability.

8. Intellectual Property

All software, branding, logos, designs, and content created by Synctower remain the property of Synctower or its licensors.

You may not copy, reverse engineer, modify, distribute, or resell the Services without prior written permission.

9. Limitation of Liability

To the fullest extent permitted by law, Synctower will not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, business interruption, or loss of data arising from the use of the Services.

Our total liability arising from the Services will not exceed the amount paid by the customer to Synctower during the twelve (12) months preceding the claim.

10. Disclaimer

The Services are provided on an "as is" and "as available" basis. Synctower makes no warranties, express or implied, regarding uninterrupted service, accuracy, or fitness for a particular purpose.

11. Suspension and Termination

We may suspend or terminate accounts that violate these Terms or misuse the Services.

Customers may terminate their subscription in accordance with their agreement. Outstanding fees remain payable.

12. Privacy

Your use of the Services is also governed by the Synctower Privacy Policy.

13. Changes to the Services

We may modify, improve, discontinue, or replace features of the Services at any time. Where practical, we will provide reasonable notice of significant changes.

14. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
